All criminal charges filed by Orange County District Attorney’s office against Brian (Babak) Abghari on March of 2016 due to his involvement in PCN3, INC. were fully dismissed on November 7, 2018. The felony complaint was based on claims by few former employees that they had not received the proper amount of prevailing wages, and other technical violations. These former employees also filed civil cases and gave conflicting testimony as to their claims which lead to questions regarding their veracity for the truth. Some, in fact, shielded themselves from inquiry about the validity of their claims by exercising their 5th amendment right against self-incrimination.
PCN3 has and does steadfastly maintain its innocence and, in fact, hired an independent third-party labor compliance company to monitor PCN3’s payroll procedures. This third-party labor compliance company could not find any labor code violations or other failures to follow the law.
PCN3 maintains that they have fallen victim of being a non-union contractor and have been subjected to questionable tactics by various labor unions and “private” compliance organizations which are funded by unions.
PCN3, in response to the untoward treatment at the hands of unscrupulous labor unions and union funded compliance organizations, has adopted the third-party labor compliance protocol to dispel any further unfounded allegations as to compliance with labor laws in the future.
